The Challenge:
A client came to us desperate for help after an Administrative Law Judge (ALJ) denied her disability claim at her hearing. Her husband was legally blind and unable to work, and the couple was facing imminent foreclosure on their home. She suffered from a laundry list of severe medical conditions. Upon reviewing the denial, we discovered a fatal flaw: the judge had based her decision solely on records from a doctor the client had visited only once, completely ignoring the vital medical evidence from the specialist who treated her regularly.
Our Strategy:
Taking a case post-hearing puts the claimant at a severe disadvantage, as the Social Security Administration (SSA) has the upper hand. After the Appeals Council wrongfully refused to remand the case, we refused to back down. We escalated the fight and filed a federal lawsuit in the Eastern Federal District of Texas.
The Result: Victory in Federal Court.
The reviewing magistrate judge agreed with our legal arguments, overturning the SSA's decision and remanding the case back to the judge to ensure the proper medical evidence was given its correct weight. We saved the client's case and protected her family's home.
